中国信访制度的历史变迁与特征:基于政策文本分析的视角

摘要: 本文运用文本分析的方法,围绕颁布时间、制度效力、政策体例和政策主题等形式特征变量,以及法律规范、模糊语言、原则性规定、立法宗旨、具体工作制度等内容特征变量对中国信访制度进行了系统地分析,并总结了其特点和不足。它的不足主要表现在:在文本效力上,缺乏一部信访法律统一规范信访工作和信访活动;在制定结构上,存在制定主体众多、结构过于分散的特点;在文本用语上,名称使用存在同构性,行为模式缺少强制性法律后果作为保障,模糊语言和原则性规定造成自由裁量问题等。

Abstract: This paper uses the method of text analysis, focusing on the formal feature variables of time, system effectiveness, policy style and policy theme, and content feature variables of legal norm, fuzzy language, principled regulation, legislative purpose and specific work system, makes a systematic analysis on China’s petition system, and summarizes the features and deficiencies. The deficiencies are mainly manifested in: in the text effectiveness, there is a lack of a petition law standardizing petition work and petition activities unifiedly; in the structure of formulation, there are many subjects and the structure is too dispersed; in the text language-using, name-using exists structural phenomenon, the behavior pattern lacks mandatory legal consequences as a guarantee, fuzzy language and principled regulation bring discretion problems.
